ARTICLE 1: PURPOSE

The purpose of this data use policy is to clearly and transparently describe how Legacy Kapital, as the data controller, processes personal data.

It applies to all personal data processing carried out by Legacy Kapital on its websites, mobile applications, during events or fairs, as well as for all direct marketing campaigns or studies.

Personal data is any information relating to an identified or identifiable natural person (hereinafter referred to as 'data subject'); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, online identifier, or one or more specific factors relating to physical, physiological, genetic, psychological, economic, cultural, or social identity.

Legacy Kapital strives to ensure that this policy, as well as the way user data is processed in practice, complies with the amended Personal Data Protection Law and the General Data Protection Regulation (GDPR). Legacy Kapital acts as a data controller within the meaning of the regulations.

ARTICLE 2: COLLECTED DATA

Each data collection form present on the Legacy Kapital website limits data collection to what is strictly necessary for the offered services. This data is collected within the framework specified below (Article 3).

However, additional data may be collected by Legacy Kapital when the user fills in the free fields of the website. Certain data must be provided for the user to access the services offered by Legacy Kapital on its website.

ARTICLE 3: COLLECTION METHODS

We use your personal data only in cases provided by applicable regulations:

Execution of an agreement we have with you;
Compliance with a legal obligation;
Your consent to the use of your data;
The existence of a legitimate interest in using your data. The legitimate interest refers to a set of commercial or professional reasons justifying the use of your data by Legacy Kapital.

These purposes are based on Legacy Kapital’s legitimate interest in having the data of its users and contacts.

DATA COLLECTION RECIPIENTS

The data is intended for the company's services to respond to your request (Marketing, Customer service, etc.) or is stored within the framework of the contractual relationship.

RETENTION PERIOD

The data is kept and used for a period in accordance with applicable laws.

ARTICLE 4. USE OF COLLECTED DATA

Legacy Kapital may use the personal data it holds for:

– Sending commercial information about its products, promotions, offers, and other information related to its products or services tailored to the interests of the data subjects;

– Information about third-party products and offers – clients or business partners of Legacy Kapital – related to the position and/or an identified interest concerning the activity of the data subject or their organization;

– Marketing this information in the form of qualified databases to third parties – clients or business partners of Legacy Kapital – based on the role and/or identified interests of the data subject or their organization;

These personal data are used by Legacy Kapital as part of its activities promoting its own products and services as well as customer prospecting on behalf of third parties. They are only used within the strict limits of applicable laws.

ARTICLE 5. DATA HOSTING

All data collected and processed by Legacy Kapital is hosted within the European Union. However, if one of its subcontractors is located outside the EU, Legacy Kapital undertakes to take all necessary measures to ensure the security of its clients' and users' data.

Legacy Kapital also undertakes to verify that these providers comply with data security and confidentiality requirements throughout the contractual relationship. Otherwise, Legacy Kapital commits to terminating their contract.

ARTICLE 6. USER RIGHTS TO THEIR DATA

Under the amended Data Protection Act and the GDPR, the user has the following rights over their data:

• The right to request access to processed data.
• The right to request the correction or deletion of processed data.
• The right to request restriction of data processing.
• The right to object to the processing of their data.
• The right to data portability.
• The right to file a complaint with the CNIL.

The latter undertakes to respond within 15 days.

ARTICLE 7. USE OF COOKIES

What is a cookie?

Cookies are exclusively managed by your internet browser, and the publisher of a cookie can decide whether or not to read or modify the information contained in it.

We regularly update and revise this privacy policy. In the event of major changes that could affect the rights of Legacy Kapital users, we will announce these changes in advance. This information will be provided in writing.
